Cultural Compliance: How to Build a Compliance Culture from Within

By Leticia Claramunt Julián, M&A Expert Lawyer with over 10 years of experience and more than 60 transactions advised.

In today’s complex business environment, compliance is no longer a mere legal formality, but a fundamental pillar for the sustainability and success of any organization. Beyond the implementation of policies and procedures, a key concept emerges: cultural compliance. This refers to the integration of regulatory compliance into the company’s DNA, making it a shared value by all members.

Building an effective compliance culture requires a comprehensive approach encompassing various areas:

i) Leadership by example: Leadership must be the main driver of compliance. Leaders must demonstrate a real commitment to compliance, acting as role models and conveying the importance of ethics and legality in all decisions.

ii) Transparent and effective communication: Clear and constant communication is essential to disseminate compliance policies and procedures. Accessible communication channels should be used and open dialogue on ethics and compliance issues should be encouraged.

iii) Continuous training: Employees must receive regular training on relevant laws, regulations, and internal policies related to their functions. The training should be practical, interactive, and adapted to the specific needs of each area.

iv) Safe and confidential reporting channels: It is crucial to establish reporting channels that allow employees to report potential irregularities without fear of retaliation. The confidentiality of reports and the protection of whistleblowers must be guaranteed.

v) Integration into organizational culture: Compliance must be integrated into the company’s values and principles. Ethical behavior should be promoted and regulatory compliance rewarded.

The reduction of legal and financial risks, which minimizes the possibility of sanctions, fines, and litigation; the improvement of reputation and trust, which strengthens the company’s image before clients, investors, and society in general; the fostering of employee trust and commitment, which increases productivity and efficiency; and the competitive advantage, given that a solid compliance culture can differentiate the company from its competitors, are some of the benefits of implementing a solid compliance culture.
